These Terms and Conditions ("Terms") govern your access to and use of the HomeWatcher App and its associated website, operated by Novasol Enterprises LLC, a California limited liability company ("we," "us," "our"). By accessing or using the app (available at app.homewatchtools.com) or website (homewatchtools.com), creating an account, or making a payment, you ("you," "your," or "Customer") agree to be legally bound by these Terms.
If you do not agree with any part of these Terms, you must not use the App or related services.
You must be at least 18 years old and authorized to enter into a binding agreement. If you use the App on behalf of a business, you represent that you have authority to bind that business to these Terms.
The HomeWatcher App is a business-to-business (B2B) software product owned and operated by Novasol Enterprises LLC, a company registered in the State of California. The official marketing site is https://homewatchtools.com, and the app is accessed through https://app.homewatchtools.com.
You are responsible for maintaining the confidentiality of your login credentials. Account sharing across multiple businesses, entities, or unaffiliated individuals is strictly prohibited. Each account is licensed to a single legal entity. Use by multiple home watch companies, franchisees, contractors, or unrelated offices in different cities or states is not allowed under the same login unless explicitly approved in writing by Novasol Enterprises LLC.
The App is intended solely for home watch services, defined as periodic property inspections and reporting on behalf of absentee homeowners. Use of the App for unrelated services or industries — including those requiring licensure or regulatory oversight — is prohibited unless approved in writing. We reserve the right to terminate accounts used for purposes beyond this scope.
The App is designed for typical home watch business operations. Excessive usage — such as unusually high property counts, bandwidth consumption, or storage — may result in additional charges, feature restrictions, or a requirement to upgrade to an enterprise plan.
We reserve the right to monitor and audit your usage to ensure compliance with fair use policies and these Terms.
You may request a data export at any time. Data exports will be processed manually upon request and are subject to availability and system limitations. Once an account is canceled, data may be permanently deleted after 30 days.
You are solely responsible for all content entered into the App, including text, notes, checklists, images, or documents. We do not moderate, verify, or control this content. You must ensure all content is lawful and non-infringing. You grant us a license to host, store, and process this data for the purpose of operating the App.
You are solely responsible for your business operations and your clients. We are not responsible for your communications, service delivery, or outcomes with property owners, tenants, or other third parties. We disclaim any liability arising from:
You agree to indemnify and hold harmless Novasol Enterprises LLC from any claims brought by your customers or third parties.
We collect and store user data to deliver the App and improve its features. This includes analytics data via Google Analytics. While not currently subject to GDPR or CCPA enforcement, we treat user data with care and will comply with privacy regulations as applicable in the future.
We offer support via email during regular U.S. business hours. We do not guarantee a specific response time or resolution time.
You may be given access to beta or experimental features. These features are provided "as-is" and may be modified or removed at any time.

We may modify, suspend, or discontinue any part of the App at any time. We will attempt to provide advance notice for major changes.
We reserve the right to suspend or terminate accounts at our sole discretion for violations of these Terms, excessive resource usage, non-payment, or abuse of the system.
All intellectual property related to the App — including code, design, branding, and content — is the property of Novasol Enterprises LLC. Unauthorized copying or reuse is prohibited.
We make no warranty that the App will be error-free, uninterrupted, or meet your specific needs. Use of the App is at your own risk.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages, including data loss, service interruptions, or customer complaints resulting from your use of the App.
You agree to indemnify, defend, and hold harmless Novasol Enterprises LLC, its officers, employees, and affiliates from any claims or liabilities related to your use of the App or your business operations.
We are not liable for failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, cyberattacks, internet outages, hosting failures, or regulatory changes.
All disputes shall be resolved by binding arbitration in the State of California, in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions or jury trials.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
We may revise these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the App constitutes acceptance of the updated Terms.
